1. Introduction

Welcome to Erasely AI. These Terms of Service ("Terms") govern your access to and use of the Erasely AI platform, services, and website (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

Erasely AI provides face monitoring, takedown-notice generation and privacy tools. Our mission is to help individuals manage their digital footprint responsibly and lawfully.

If you do not agree to these Terms, you must not access or use our Services.

2. Our Services

Erasely AI offers the following primary services:

• Face Monitoring: Recurring searches of public sources for images that appear to show a face you have submitted, with email notification when a new match is found. Governed additionally by our Biometric Data Policy.
• DMCA Takedown Letter Generation: Preparation of formatted copyright takedown notices as downloadable documents. You are responsible for sending any notice we generate. Erasely AI does not submit notices, correspond with platforms, or pursue removals on your behalf.
• Disposable Email Addresses: Temporary inboxes for receiving mail without disclosing a personal address.
• One-Time-Passcode Phone Numbers: Temporary numbers for receiving verification messages.

Erasely AI is not a data broker opt-out service, does not file removal requests with data brokers, and does not provide background checks, identity verification or investigative reports on other people.

All services are provided on a subscription or per-request basis as outlined in your service agreement or account dashboard.

3. Consent and Legal Compliance

3.1 Your Representations and Warranties

By using our Services, you represent and warrant that:

• You have obtained explicit, informed consent from all individuals whose data you process through our platform;
• You are legally authorized to request data erasure, monitoring, or reporting for the subjects in question;
• You will use our Services only for lawful purposes and in compliance with all applicable laws, including but not limited to data protection regulations (GDPR, CCPA, etc.);
• You will not use our Services to stalk, harass, intimidate, or harm any individual;
• All information you provide to Erasely AI is accurate, current, and complete.

3.2 Prohibited Uses

You may NOT use our Services to:

• Monitor, gather information about, or request data erasure for any individual without their explicit consent;
• Engage in surveillance or intelligence gathering for unlawful purposes;
• Violate any person's privacy rights or other legal rights;
• Circumvent or attempt to circumvent any technological measures we implement;
• Access data or systems without authorization;
• Use our Services in any manner that could damage, disable, or impair our platform.

3.3 Verification Rights

Erasely AI reserves the right to request proof of consent or legal authorization at any time. Failure to provide adequate documentation may result in immediate suspension or termination of your account and Services.

4. Account Registration and Security

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete registration information;
• Maintain the security and confidentiality of your account credentials;
• Notify us immediately of any unauthorized access or security breach;
• Accept responsibility for all activities that occur under your account;
• Be at least 18 years of age or the age of majority in your jurisdiction.

Erasely AI reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Payment and Billing

Certain Services require payment of fees. By subscribing to a paid service, you agree to:

• Pay all applicable fees as described in your service plan;
• Provide current, complete, and accurate billing information;
• Authorize us to charge your payment method for all fees incurred;
• Pay all applicable taxes associated with your use of the Services.

Refund Policy: Every plan carries a 30-day money-back guarantee. If you are not satisfied, contact us within 30 days of your initial purchase and we will refund that payment in full. The guarantee applies to your first payment on a plan, not to subsequent renewals; renewals can be avoided by cancelling before the billing date. After 30 days, refunds are at our discretion, and we will always issue one where we have failed to deliver the Service. Refunds are returned to the original payment method.

Subscription Renewals: Subscription-based services automatically renew at the end of each billing cycle unless cancelled prior to renewal. You may cancel your subscription at any time through your account dashboard.

6. Intellectual Property Rights

The Services, including all content, features, functionality, software, designs, text, graphics, logos, and trademarks, are owned by Erasely AI and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purposes. You may not:

• Copy, modify, distribute, sell, or lease any part of our Services;
• Reverse engineer or attempt to extract source code from our platform;
• Remove or alter any proprietary notices or labels;
• Use our Services to create a competing product or service.

7. Data Processing and Privacy

Our collection, use, and processing of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

When you use our Services to process information about third parties, you act as a data controller, and Erasely AI acts as a data processor. You acknowledge that:

• You are responsible for complying with all applicable data protection laws;
• You must have a lawful basis for processing personal data through our Services;
• You will handle all data subject requests (access, deletion, etc.) as required by law;
• Erasely AI will process data only as instructed by you and as necessary to provide the Services.

8. Service Limitations and Disclaimers

8.1 No Guarantee of Results

While we make commercially reasonable efforts to provide effective Services, Erasely AI does not guarantee:

• Complete removal of all personal information from the internet;
• Compliance by third-party websites or data brokers with erasure requests;
• That monitoring services will detect all instances of data appearance;
• Any specific outcomes or results from use of our Services.

8.2 Third-Party Compliance

Data erasure effectiveness depends on third-party compliance with legal obligations and our requests. Some entities may refuse or delay compliance, which is beyond our control.

8.3 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERASELY AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, or business opportunities;
• Service interruptions or data loss;
• Third-party actions or failures to comply with requests;
• Your violation of these Terms or applicable laws;
• Unauthorized access to or use of our servers or your data.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO ERASELY AI IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Erasely AI and its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Services;
• Your violation of these Terms;
• Your violation of any rights of third parties, including privacy rights;
• Your failure to obtain necessary consent for data processing;
• Any content or information you submit through the Services;
• Your violation of applicable laws or regulations.

11. Term and Termination

These Terms remain in effect while you use our Services. You may terminate your account at any time by contacting us or using account settings.

Erasely AI may suspend or terminate your access immediately, without notice, if:

• You breach these Terms;
• You use Services for illegal or unauthorized purposes;
• We are required to do so by law;
• We reasonably believe continued access poses a risk to us or others;
• Your account remains inactive for an extended period.

Upon termination, your right to use the Services ceases immediately. Provisions regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Erasely AI regarding the Services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

Erasely AI shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemic, or government action.

By using our Services, you consent to receive electronic communications from us. These communications may include notices about your account, service updates, and marketing materials (which you can opt out of).
